Acceptance

Using this website means accepting these terms. If you disagree with any of them, please do not use it. The version in force is always the one published on this page, bearing the date shown above.

Who sells

The website is operated by AM14 LLC as marketing and sales agent. The party that sells, manufactures and invoices is LONGTREE COMPANY S.A.. Full details of both are in the Legal Notice.

Permitted use of the website

We ask you to use this website lawfully and in good faith. In particular, you may not:

  • Reproduce, distribute or adapt its content for commercial purposes without written authorisation.
  • Use it for fraudulent or unlawful activities.
  • Introduce viruses, malware or any code that could harm the site or its visitors.
  • Extract content on a massive, automated basis, or deliberately overload the servers.
  • Submit third-party data through the form without being entitled to do so.

Conditions of sale

We sell business to business, at a distance, to customers in Latin America, the United States, the European Union and other markets. These general conditions apply unless your quotation or your contract says otherwise in writing.

The offerWhat is published on the website is commercial information, not a binding offer. The only binding offer is the quotation or pro forma invoice issued in writing by the seller, with its stated validity period.
The orderThe order is confirmed once the seller accepts the signed quotation and receives the agreed down payment. The specific payment terms are those of each pro forma invoice.
Prices and currencyPrices are in US dollars and on the delivery terms (Incoterms) stated in the quotation. Unless stated otherwise, they do not include freight, insurance, customs clearance, duties, indirect taxes, civil works or installation.
Taxes and customsTaxes, duties and import formalities in the country of destination are for the buyer’s account, as are the appointment of the importer and the clearance itself.
Lead timesThe manufacturing lead time is the one stated on the model’s product page and in your quotation, and runs from confirmation of the down payment. Freight is quoted separately: we commit to the manufacturing lead time, not to a transit date.
Delivery and riskDelivery and the passing of risk take place in accordance with the agreed Incoterm. Please inspect the goods on receipt and record any damage on the transport document.
WarrantyProducts carry the written warranty supplied with the quotation, with the scope and duration stated there for each component. It covers manufacturing and material defects; it does not cover normal wear, or damage from transport, incorrect installation, misuse, lack of maintenance or force majeure.
InstallationUnless expressly agreed, the sale does not include civil works or assembly at destination. Where a third party carries out the assembly, it must follow the installation manual for the warranty to remain valid.
ClaimsWrite to info@orionxsport.com quoting the quotation or order number. We will confirm receipt and tell you what documentation we need.

These are business-to-business sales: the right of withdrawal provided for consumers in distance contracts does not apply. If you are contracting as a consumer, please tell us before signing and we will set out the conditions that apply.

Limitation of liability

We take reasonable care to keep the information on the website accurate and available, but we do not warrant that it is error-free or that the service will be uninterrupted. To the extent permitted by the applicable law, AM14 LLC and LONGTREE COMPANY S.A. are not liable for loss of profit or for indirect or consequential damages arising from use of the website. Nothing above excludes liability that cannot lawfully be excluded, including liability for wilful misconduct or personal injury.

Governing law and dispute resolution

Use of the website is governed by the laws of the State of Florida (United States), with submission to the courts of Miami-Dade County. The sale is governed by whatever each contract or quotation agrees; failing agreement, by the laws of the Republic of Panama, where the seller is established. If you contract as a consumer and reside in the European Union, you retain the protection of the mandatory rules of your country of residence.

Amendments

We may amend these terms. Changes are published on this page with their date; an order already confirmed remains subject to the terms in force when it was confirmed.
